SMS Terms and Conditions

Agreement to These Terms

By enabling SMS in your Bracken account settings, you confirm that you have read, understood, and agree to these Terms and Conditions. You must agree to these terms in order to use the Bracken AI SMS service. If you do not agree, do not enable SMS messaging.

Age Requirement

You must be at least 18 years of age to use this service. By opting in, you confirm that you meet this requirement. This requirement applies because the Bracken AI service is powered by Anthropic, whose usage policies require users to be 18 or older.

Program Description

This SMS service is provided by Bracken Utility Transport Service. By opting in, you agree to receive transactional text messages from Bracken regarding operational assistance — including looking up and updating client records, material pricing, and related business data — via an AI-powered assistant. Messages are sent only in response to inbound messages you initiate. No promotional or marketing messages will be sent.

AI Technology — Anthropic

The Bracken AI SMS assistant is powered by Anthropicusing the Claude API. By using this service, you also agree to comply with Anthropic's Usage Policy. Anthropic's models may not be used for prohibited purposes as defined in their policy.

Information We Collect

When you use the Bracken AI SMS service, we collect the following information:

• Your mobile phone number (used solely to send and receive SMS messages)
• The content of messages you send to the service
• Timestamp and delivery metadata for each message

This information is used exclusively to provide the SMS service — responding to your business queries and maintaining conversation context. We do not use this information for advertising, marketing, or any purpose other than delivering the service you requested. Message content may be processed by Anthropic's API to generate responses; please do not send sensitive personal information via SMS.

How to Opt In

You may opt in by enabling the SMS toggle in your account Settings page on the Bracken platform. By checking the SMS consent checkbox, you explicitly agree to these Terms and Conditions and confirm you are 18 years of age or older. Only registered Bracken users with a verified phone number on file may opt in. Mobile opt-in data and consent will not be shared with any third parties.

Message Frequency

Message frequency varies based on your activity. You will receive one reply per message you send. Estimated maximum: up to 20 messages per month depending on usage. No unsolicited messages will be sent.

Charges

Message and data rates may apply depending on your mobile carrier and plan.

How to Opt Out

To stop receiving messages, reply STOP to cancel at any time. You may also disable the SMS toggle in your Bracken account Settings page or contact us at mike@jpower.ai. After opting out, you will receive one confirmation message and no further messages will be sent.

Carrier Liability

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier's network availability and is not guaranteed.
